TweetFast Terms of Use

Preamble

Welcome to TweetFast! Your trust matters to us. These Terms of Use ("Terms") govern access to and use of our service for creating, interacting, and growing on the X platform (formerly Twitter).

By using TweetFast, you fully accept these Terms. If you disagree with any part of them, please do not use the service.

1. Company Information

2. Description of the Service

2.1 Purpose

TweetFast is a Chrome extension that helps creators, entrepreneurs, and community managers automate, accelerate, and enhance their presence on X (formerly Twitter) thanks to AI.

2.2 Key Features

• Creation & Engagement: one-click tweet and reply generation, custom tones, global instructions, meme templates.
• Promotion & Growth: add projects to promote, AutoLike/AutoRepost on selected accounts, tweet scheduling.
• Organization & Analytics: editorial calendar, engagement statistics, performance tracking.

3. Plans and Business Model

Current plans and pricing are displayed on the site/app when you subscribe.

3.1 Pricing

• Prices are quoted in USD, tax included.
• VAT not applicable, Article 293 B of the French Tax Code (VAT exemption for the sole proprietorships named above), unless stated otherwise following a change of legal status.
• Pricing may change with 30 days' notice for active subscriptions.

4. Service Access and Account Creation

4.1 Eligibility

• Minimum age: 16; legal capacity required.
• If under age, authorization from a legal guardian is necessary.

4.2 Registration

• Sign up via the TweetFast extension.
• Log in using Google OAuth.

4.3 Account Security

• You are responsible for keeping your credentials confidential.
• Any action performed from your account is deemed to be yours.
• If your account is compromised, contact contact@tweetfa.st.

5. User Obligations and Acceptable Use

5.1 Proper Use

• Use TweetFast only for its intended purpose and in line with these Terms.
• Do not disrupt or degrade the service.

5.2 Prohibited Content

• Illegal, malicious, hateful, or child sexual abuse content.
• Spam or copyright infringement without authorization.

5.3 Third-Party Intellectual Property

• You must ensure you hold the rights to use and reproduce any third-party content.
• You are solely responsible for imported or generated content and hold TweetFast harmless from any claims.

5.4 Third-Party Platforms (X/Twitter, etc.)

• Compliance: you agree to comply with the terms of third-party platforms.
• Warning: certain automated actions may violate their rules and lead to sanctions by those platforms.
• Liability: TweetFast is not liable for measures taken against your account by third parties.

5.5 Reasonable Use and Actions

• Normal individual usage is expected; no abusive or large-scale automated use.
• In case of abuse: throttling, limitation, suspension, or termination after notice (unless urgent).

6. Intellectual Property and Content

6.1 TweetFast's Ownership

• The service's code, design, brand, and components are protected by copyright.
• FRITSCH LOIC and GREP ONE hold the exploitation rights, according to their internal agreements.
• Unauthorized reproduction is prohibited.

6.2 Your Content

• You remain the owner of your content.
• You grant a limited, non-exclusive license to host, process, and analyze your content strictly as needed for the service.
• Duration: as long as you use the service.

7. Ordering and Payment

7.1 Subscription

• Select a plan, provide payment details, receive an email confirmation.
• Activation occurs once payment is received.

7.2 Payment

• Provider: Stripe, Inc. (secure payments).
• Methods: major payment cards.
• Billing: monthly on the anniversary date; recurring charges.

7.3 Payment Issues

• Automatic retries occur if a payment fails.
• Paid features may be suspended if the failure persists; termination may follow after notice.

8. Term, Renewal, Termination

8.1 Term

• Subscriptions are commitment-free and renew automatically each month or year depending on the plan selected.

8.2 Termination by the User

• Cancel at any time via the customer area or by email.
• Renewal stops; access continues until the end of the paid period.
• No refund for the current billing period.

8.3 Termination by the Publisher

• Possible in case of serious breach, after notice (unless urgent).

8.4 Data Retrieval

• Exports available (JSON, CSV or standard formats).
• Data kept for 30 days after termination for retrieval, then deleted unless legally required otherwise.

10. Personal Data and Privacy

10.1 Data Controllers

FRITSCH LOIC and GREP ONE act as joint data controllers. GDPR contact: contact@tweetfa.st.

10.2 Principles

• Collection limited to what is necessary (account, email, logs, cookies, etc.).
• Purposes: account creation and management, service delivery, improvement, statistics, security.
• Legal bases: contract performance, consent (where applicable), legitimate interest (security, improvement).
• Retention periods proportionate to the stated purposes.

10.3 Privacy & AI

• Segregation: your data is not used to train AI models for other customers.
• Your content may be processed by AI services solely to deliver TweetFast features.

10.4 Processors and Transfers Outside the EU

• Primary hosting: Contabo GmbH (EU) – data stored in the EU whenever possible.
• AI services: OpenRouter, OpenAI, Google, Anthropic, Mistral, Voyage AI, Cohere.
• Payments: Stripe, Inc. (USA).
• File hosting: Cloudflare (USA).

Transfers outside the EU: certain processing activities (payments/AI) involve transfers to third countries (mainly the USA) with appropriate safeguards (standard contractual clauses, etc.).

10.5 User Rights

• Access, rectification, erasure, portability, objection, restriction.
• Exercise your rights at contact@tweetfa.st. You may lodge a complaint with the CNIL.

11. Security and Availability

11.1 Best-Efforts Commitment

• Service available 24/7, subject to scheduled maintenance and technical contingencies.

11.2 Updates

• Regular improvements; important changes will be communicated.

11.3 Technical Security

• TLS/SSL encryption in transit, encryption at rest (e.g., AES-256) where relevant.
• Restricted internal access; no access to your content without explicit support needs.
• Relevant breaches reported within 72 hours to authorities and affected individuals, when required.

12. Limitation of Liability

• No liability for indirect damages (loss of data, profits, or reputation).
• No guarantee regarding the accuracy of AI outputs; you are responsible for verifying them.
• No liability for third-party content or for decisions/sanctions imposed by external platforms.

13. Third-Party Services and Integrations

• Some features depend on third-party APIs/services that may impact availability.
• You must comply with their terms of use.

14. Legal Warranties and Support

• Statutory warranties for consumers (conformity, hidden defects) apply under French law.
• Support: contact@tweetfa.st (response within 48 business hours).

15. Changes to the Terms

• We may amend the Terms to reflect legal or service changes.
• Notification by email and/or in-app; 30 days' notice for material changes.
• Continuing to use the service constitutes acceptance.

16. Governing Law and Dispute Resolution

• These Terms are governed by French law.
• In case of dispute, you may seek consumer mediation (European ODR platform: ec.europa.eu/consumers/odr/).
• If no amicable solution is reached, the courts of Paris have jurisdiction, subject to mandatory protective rules.

17. Miscellaneous

• Severability: if any clause is void, the others remain in force.
• Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and the TweetFast publishers.
• Language: the Terms are drafted in French; in the event of translation, the French version prevails.
